Advertisers accept the following conditions from the time they send their application for registration as an advertiser. This contract shall have all the effects stated under the Spanish legal system, whenever consent and the other requirements necessary for its validity are met, in accordance with the terms of Act 34/2002, of 11 July, on Information Society Services and Electronic Commerce and in accordance with Royal Decree 1906/1999, of 17 December, under which electronic contracts are regulated. Lack of knowledge of the following conditions shall not exempt users from their acceptance.

1. The contract shall be understood as made with Intergest Publicidad S.L., with Fiscal Identification Nº B-96883822, and registered office in Av. Blasco Ibáñez 11, 46529, Canet, Valencia, hereinafter THE COMPANY.
2. We shall undertake to maintain your advertisements in the www.CasaSpain.com directory and to distribute, offer and publish them by all methods, in order to promote the contract directly and make properties known to potential clients, for the period of 1 year. THE COMPANY shall undertake to make investments in Spanish and foreign magazines and search engines to promote contracting of your offers.
3. The advertising contract shall include maintenance of your advertisement for 1 year in the www.CasaSpain.com directory with the following services:

5. The contents of advertisements shall be the same as the description given by advertisers on the standardized insertion forms. These contents can only be modified in terms of the personalized description within 30 days from the advertisement appearing. The same shall apply to the fields referring to availability, offers and prices, using the forms available. Photos can only be substituted within the limit of one change per year. Apart from the personalized description written by you, the rest of the details stated by you using the checkboxes, option buttons and text boxes shall automatically appear in your advertisement in the form of a standard record. The design of this record may be subject to modification by the COMPANY during the year in which the contract runs.
6. Advertisers shall undertake to update the information in their advertisements using their advertiser passcode. They shall also be obliged to request correction of any data that may lead to an error or confuse recipients, which they are unable to correct themselves using the means made available to them by us, and shall be liable to third parties for failure to fulfil this obligation.
7. For technical reasons, maintenance work or other reasons due to force majeure outside the control of the company, advertisers shall accept the possibility of the directory not being available for a period equal to or less than a total of 24 hours per year.
8. Start of contract. Contracts for private advertisers shall come into force on the day on which their advertisement appears on www.CasaSpain.com. Contracts for companies shall come into force on the day on which the first of their advertisements appears, regardless of the number of advertisements contracted and the date on which successive advertisements appear.  Calculation of the contract year shall take place from the start date of the contract year.
9. No advertisements shall be placed nor shall they be kept registered for properties or rentals on which circumstances have intervened which make them unfit for the purposes stated. Amongst other cases this includes: 1. Properties which have been sold, 2. Properties rented for periods longer than the end of contract date, 3. Companies which have wound up their business. Advertisers shall undertake to inform us of these situations as soon as they occur. The company reserves the unilateral right to withdraw advertisements for properties included in these cases, and also when repeated complaints have been received or evidence is available which indicates that the details of the advertisements are not true.
10. THE COMPANY shall undertake to receive complaints from recipients of the advertisements and pass them on to advertisers, the latter being obliged to answer the recipient directly and to make known to THE COMPANY any arguments they may present or whether they are in agreement with the complaint. In this way, THE COMPANY shall be able to use its own judgement when it comes to deciding on whether to withdraw the advertisement if repeated complaints are received, in accordance with what is stated in the above clause.
11. We reserve the unilateral right to cancel the contract without return of the sum paid if advertisers do not respond to the contacts sent to them by e-mail within a period of less than 7 days from receipt and with the use of good manners and politeness, without having a negative effect on the image of the CASASPAIN brand.
12. If advertisers opt not to include the maximum number of advertisements contracted, there shall be no return of the price paid for the proportion of advertising space which has not been used.  Nor shall the company return the sum paid if no contacts or reservations are obtained due to a reason which is attributable to the advertiser, or, furthermore, if the advertiser wishes to cancel the contract before it reaches termination.
13. Advertisements are selected from our database according to random search criteria which refer, amongst other things, to the type of property, number of people according to range, price and location. The COMPANY does not guarantee a specific position for advertisements according to criteria based on how long the advertisement has been on the website or other similar criteria, unless a preferential positioning service has been contracted.
14. When advertisers wish to renew the contract for their advertisement, they shall have the right to substitute the property advertised for another one or to modify the description of the existing one. This right shall be exercised within the 30 days following renewal. After this date, no change shall be allowed to the advertisement and, in all cases, any of the above modifications shall be considered as a new advertisement.
15. We reserve the right to distribute in all the media the information on and photographs of the properties advertised, without prior authorization, considering the advertisers as owners of the copyright for the images and other data provided by them, without us being responsible for their origin and with advertisers being considered as authorized to distribute them.
16. The company shall not be held responsible for the veracity of the details of the properties and their location, since it shall consider in good faith that they are true and shall recommend to any interested parties that prior to formalizing any contract for purchase, rental or accommodation, they check the veracity of the details advertised. Responsibility for the information published falls on the advertisers as well as on the contracting party who fails to take notice of the warning about checking the information. All type of direct or indirect responsibility is delegated onto them for the validity, content, statements or omissions in the information on the properties.
17. Advertisers shall refrain from using the details of the clients provided by us for purposes other than the specific consultation in question. Client details provided by us shall not be kept for a period longer than that necessary for replying to the query, all in accordance with Organic Law 15/1999, of 13 December on Personal Data Protection.
18. Payment for our services shall be made prior to insertion of the advertisements. The company reserves the right to modify prices published on the website without prior notification.
19. Advertisements shall be withdrawn if, within 5 calendar days from the date of termination of the service contracted, payment for renewal has not been made. To contract the service again, the debt shall be paid in full and in advance.
20. We reserve the right not to renew contracts for properties which do not meet the minimum quality standards required, those about which repeated complaints have been received from clients or about which we have evidence that the details supplied by advertisers are untrue.
21. Rights to operate the web pages and other publicity creations shall be considered as transferred exclusively to the COMPANY. Web pages shall be considered as created in order to be hosted and linked from the properties included in the CASASPAIN database.
22. The company reserves the right to modify without notice the prices, contents and photographs on the home page of the CASASPAIN brand as well as the variables which define the properties in the database. We reserve the right to modify the format of your advertisement (apart from the personalized description) due to service requirements.
23. No web pages from advertisers shall be linked if they contain properties other than those advertised on www.CasaSpain.com . This situation shall only be allowed with professional advertisers and shall be agreed beforehand through acceptance of a personalized budget.
24. “Professional” advertisers shall be understood as those who manage several properties or accommodation units such as apartment complexes, duplex apartment complexes, aparthotels or tourist complexes, whether or not owned by them. Professional advertisers shall be obliged to publish a minimum number of advertisements on www.CasaSpain.com or shall accept a price other than those published for non-professional advertisements. If the company has knowledge that requests for accommodation sent by the COMPANY are being used to occupy various units or properties other than those advertised, without having applied for the "professionals" option, the advertiser shall be removed within 1 week from the time of presentation of a new budget if no confirmation and payment by return is received.
25. No advertisements shall be carried for companies or individuals who are in direct or indirect competition with CasaSpain, nor shall links be made to web pages which contain sexual and/or pornographic contents. No links shall be made to web pages which generate pop-ups or other unsolicited advertising or those which contain dialers.
26. The accommodation/advertisement reference defines each advertisement uniquely. It may be modified by CasaSpain to avoid coincidences. It may not be modified by advertisers.
